This Privacy Notice (“Notice”) describes how Latitude AI LLC, our parent company Ford Motor Company, and our affiliates (“Latitude AI,” “our,” “we,” or “us”) collect, use, and disclose Personal Information. This Notice covers your interactions with our on-road test vehicles (“Vehicles”), https://lat.ai/ or any websites, mobile applications, devices, or online and offline platforms and locations where this Notice is presented to you (collectively, the “Site”).

California Privacy Notice

“Personal Information” means any information related to an identified or identifiable natural person, subject to applicable data protection laws. Personal Information includes the term “personal data” as used in data privacy laws.

Depending on the nature of your interaction with us, we may collect the following types of Personal Information about you, some of which may be considered sensitive Personal Information under applicable law. Note that the specific Personal Information we collect about you may not include all the examples listed.

• Identifiers, including name, postal address, unique personal identifier, online identifier, IP address, email address, phone number, or other similar identifiers.
• Commercial information, including records of products or services purchased, obtained, considered, or used on behalf of your affiliated entity.
• Internet or other electronic network activity information, including browsing history, search history, and information regarding your interactions with our Site.
• Location data, including time zone and geolocation, such as location data inferred from your device IP address and precise geolocation information collected by the Vehicles (this precise geolocation information is not used to identify an individual)
• Audio, electronic, visual, or similar information, including when you are in our office and video footage/photographs of you are collected by CCTV cameras, video and/or audio security footage, or as requested of you by Latitude AI security personnel.
• Content of communications, including emails, posts to social media pages, and other requests.
• Professional and employment-related information, including your affiliated entity and job title.
• Vehicle Telemetry Information, including the vehicle's origin, destination, speed, direction, miles driven, and route information (this Vehicle Telemetry Information information is not used to identify an individual).
• Camera and Audio Information, including images, video recordings, audio recordings, or other indication of a person (or a pet, house, mailbox, stop sign, etc.) (this Camera and Audio Information is not used to identify an individual).
• Inferences used to create a profile reflecting your preferences, characteristics, abilities, and aptitudes.

How We Use Personal Information
We may use Personal Information for the following purposes:

• Conduct Business. We may use your Personal Information to conduct business with your affiliated entity, such as processing transactions and orders for your affiliated entity; providing customer support; and generating website analytics to improve our platforms and systems.
• Operate, Maintain, and Improve our Site. We may use your Personal Information to understand how you use our Site; customize or personalize your experience; monitor and analyze trends, usage, and activities of Site users; compile user data, including with data about users that we collect through other sources and may be used for marketing and other purposes; deliver promotional content; improve our Site; develop new products, services, and marketing; provide technical support and troubleshoot; offer customer assistance; and safeguard our Site.
• Communication. We may use your Personal Information to communicate with you, such as by providing you information on products and services that may benefit you or your affiliated entity and sending you technical notices, updates, security alerts, information regarding changes to our policies, and support and administrative messages. We may also use your Personal Information to communicate with you when you contact us.
• Legal Obligations and Security. We may process your Personal Information to fulfill our legal obligations, including reporting and tax documentation; prevent, investigate, identify, or take any other action regarding suspected or actual fraudulent or illegal activity, or any activity that violates or may violate applicable laws, regulations, legal processes, or our policies. We may use, screen, and share your Personal Information as part of our due diligence procedures; to assist in verifying your identity; to facilitate and manage our relationship with you; and to protect our or others' interests. We may process your Personal Information to comply with applicable laws, regulations, or legal processes as well as industry standards and our company policies. Additionally, we may process your Personal Information to meet our contractual and legal obligations and protect the security of our systems and personnel.
• Corporate Restructuring. We may use your Personal Information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred.
• Direction or Consent. We may use your Personal Information for other purposes at your direction or with your consent.
• Research and Development. We may use geolocation information, Vehicle Telemetry Information, and Camera and Audio Information to research and develop new products for Ford Motor Company.

How We Collect Personal Information

We may collect Personal Information identified above from the following sources (whether we collected information from a specific source depends on the nature of your interaction with us):

• Directly from you or your agent. We may collect Personal Information from you when you provide it to us, such as in connection with a purchase order or when you contact us.
• Partners. We may collect Personal Information about you from our partners that offer co-branded services, sell or distribute our products, or engage in joint marketing activities.
• Parties acting on our behalf. We collect Personal Information about you from certain agents, vendors, consultants, affiliates, and service providers that provide information to help us manage or operate our business.
• Social Networks. We may collect Personal Information about you when you engage with our content, reference our Site, or grant us permission to access information from social networks.
• Third Parties. We may obtain Personal Information from third parties, some of whom may sell the information to us, to help us provide goods and services, update and improve our records, and suggest services that may be of interest.
• Affiliates and Family Companies. We collect Personal Information from companies within the Ford Motor Company family of companies and affiliates. We receive information within this “family,” as permitted, to help us manage our business and workforce.
• Law enforcement agencies, courts, regulatory agencies, and other government agencies. We may receive information from government agencies to comply with the law, to protect your personal safety or the safety of others, to protect our or others' rights, or to investigate fraudulent or illegal activity, or any activity that violates or may violate applicable laws, regulations, legal processes, or our policies.
• Your Affiliated Entity. We may receive information about you from your affiliated entity to help us manage or operate our business.
• Parties to corporate transactions. As permitted by law, we may receive Personal Information as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of a business or assets.
• Public sources. We may also collect information available on public company registers about you or other public sources associated with your business.
• Automatically when using the Site. We automatically collect certain information about you when you use our Site.
• The Vehicles. The Vehicles are equipped with cameras and sensors to detect and record its surroundings through electromagnetic, optical, and acoustic waves (e.g. radar, video, LIDAR, GPS, and microphones). Vehicles are equipped with video cameras and microphones to record their surroundings.

We may combine Personal Information we obtain about you from one source with Personal Information we obtain through other means described above.

How We Use Cookies and Tracking Technologies

Our Site uses cookies, web beacons, and similar digital technologies (“Tracking Technologies”) to operate our Site and to help collect data. Cookies are small text files placed on your device to store data that can be recalled by a web server in the same domain that placed the cookie. The text in a cookie often consists of a string of numbers and letters that uniquely identifies your device, but it can contain other information as well. Our Site may also contain electronic images known as web beacons (also called single-pixel gifs) that we use to help deliver cookies on our Site, count users who have visited our Site, and gather usage and performance data.

Tracking Technologies on our Site are used to store your preferences and settings, combat fraud, analyze how our Site performs, personalize your experience, and fulfill other legitimate purposes.

Our Site often include Tracking Technologies from third-party vendors. In some cases, that is because we have hired the third party to provide services on our behalf, such as site analytics. In other cases, it is because our webpages contain third-party content (such as embedded videos, maps, plug-ins, or ads) that contain digital technologies used to track operability and performance of the content, as well as your interaction with the content to determine its effectiveness. When your browser connects to a third party's web server to retrieve content and/or Tracking Technologies, that third party is able to set or read its own Tracking Technologies on your device and may collect information about your online activities over time and across different websites or online services also contain that third party's content or Tracking Technologies.

For example, our Site uses third-party tools (such as Google services), to support the operation and performance of our Site and to analyze your interactions and experiences with our Site, including the features you engage with, how you navigate, and your click/touch, movement, scroll, and keystroke activity.

Disclosures of Personal Information

We disclose Personal Information with your consent, when you direct us to share it with others, in order to conduct business with your affiliated entity, and otherwise to operate our business. We may disclose your Personal Information for the purposes above to the following:

• Our affiliates and family companies. We disclose your Personal Information to our affiliates and family of companies for business and operational purposes, including maintaining and improving existing prodcuts and services and creating new products and services.
• Agents, vendors, consultants, and service providers. We may disclose your Personal Information to agents, vendors, consultants, and service providers that help us provide the Site and operate our business.
• Law enforcement agencies, courts, regulatory agencies, and other government agencies. We may disclose your Personal Information to comply with reporting obligations (such as taxing authorities), legal processes (such as court orders, subpoenas), or other legal requirements of any governmental authority, whether in connection with threatened or actual litigation or otherwise, to protect our legal rights or property, to enforce our policies and procedures, to protect the legal rights or property or physical security of others, or for the prevention or detection of crime.
• Insurers and professional advisers. We may disclose your Personal Information to manage risks, obtain professional advice, perform investigations, and exercise or defend against legal claims.
• Third parties. We may disclose Personal Information to third parties where instructed by you; as necessary to fulfill the service or provide the good you request; or to prevent, detect, investigate, identify, or take any other action regarding suspected or actual fraudulent or illegal activity, or any activity that violates or may violate applicable laws, regulations, legal processes, or our policies.
• Parties to corporate transactions. We may disclose your Personal Information as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of a business or assets.
• Consent. We may disclose your Personal Information to other individuals or entities with your consent.

Choice and Control of Personal Information

Cookies and Tracking Technologies

You can opt out of certain cookies and other technologies by clicking on the Cookie Settings link in the footer of our websites. You can also learn more by visiting our Your Privacy Choices Page and the additional information below.

Browser controls. Web browsers vary on whether they are set to accept or allow various types of cookies and similar digital technologies by default. You can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies and similar digital technologies, this could affect certain features or services of our Site. If you choose to delete digital technologies, settings and preferences controlled by those digital technologies, including advertising preferences, may be deleted and may need to be recreated.

Do Not Track. Some browsers have incorporated “Do Not Track” (“DNT”) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our website does not currently respond to browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls described above.

Email Communications

A recipient may unsubscribe from our marketing email communications by clicking the “unsubscribe” link found in every marketing email we send. If a recipient opts out of our marketing email communications, we may still send email messages related to the recipient's account or the Site. Unsubscribing from our marketing communications will not affect the level or quality of service we provide.

Other Sites and Services

Our Site may contain links to other content, products, services, features, websites, mobile applications, platforms, or properties that Latitude AI does not own or operate (“Other Sites”) even if they look similar to ours. Please be aware that Latitude AI is not responsible for any Other Sites, their content or operation, or the privacy policies or data practices of the parties that offer the Other Sites, even if you access them via our products or services.

Our Site may incorporate the Google reCAPTCHA tool, which collects hardware and software information, such as device and application data, in order to perform integrity checks and help prevent bots from using the feature. Your use of the reCAPTCHA tool is subject to the Google Privacy Policy and Terms of Use.

Latitude AI is also not responsible for third-party applications or services that are governed by a privacy policy other than Latitude AI's and that may:

• Be integrated with or offered through our Site; or
• Require or permit by the account you have with the third party to be linked to our Site.

Location of Personal Information

The Personal Information we collect may be stored in, accessed from, and processed in the United States, your country or region, or in any other country where we or our affiliates, subsidiaries, or vendors maintain facilities. The storage location(s) are chosen for efficient operations and to improve performance. We take steps designed to ensure that the data we collect under this Notice is processed according to the provisions of this Notice and applicable law wherever the data is located. Please be aware that the data protection laws and regulations that apply to your Personal Information that is transferred to the United States or other countries may be different from the laws in your country of residence, and different standards may apply to how your Personal Information is used and protected.

Security of Personal Information

While no systems, applications, or websites are 100% secure, we take reasonable and appropriate steps to help protect Personal Information from unauthorized access, use, disclosure, alteration, and destruction.

Changes to this Notice

We reserve the right to amend this Notice at our discretion and at any time. When we post changes to this Notice, we will change the “Effective Date” at the top. If we make material changes to this Notice, we will provide notice or obtain consent regarding such changes as may be required by law.

California Privacy Notice

This California Privacy Notice (the “CA Notice”) describes how Latitude AI collects, uses, and discloses the Personal Information of California residents who interact with Latitude AI. It also explains your rights relating to Personal Information under the California Consumer Privacy Act, as amended (the “CCPA”).

Unless otherwise noted, the disclosures and Information Practices contained within this CA Notice describe our current practices and our practices for the twelve (12) months preceding this notice's Effective Date.

This CA Notice supplements other parts of our Notice and provides additional information for California residents. In the event of a conflict between any other Latitude AI policy, statement, or notice and this CA Notice, this CA Notice will prevail as to California residents' rights under the CCPA. Capitalized terms in this CA Notice have the same meaning as the matching terms defined in the CCPA or our main Notice.

California Personal Information Processing

Within the preceding twelve (12) months, we have not sold or shared for cross-context behavioral advertising the Personal Information described in this Notice.

We do not collect Sensitive Personal Information about California Consumers.

How Long We Keep Your Personal Information

We keep the categories of Personal Information described above for as long as is necessary for the purposes described in this Notice or otherwise authorized by law. This generally means holding each category of information for as long as one of the following criteria apply:

• If your Personal Information is reasonably necessary to manage or conduct our business operations, manage our relationship with you, or satisfy another compatible purpose or reasonably necessary purpose for which we collected the Personal Information and provided you notice;
• If your Personal Information is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or
• If we are otherwise required or permitted to keep your Personal Information by applicable laws or regulations.

Where your Personal Information is used for more than one purpose, we may retain it until the purpose with the latest-in-time period expires. For more information about our retention policies, please contact us using the contact details below.

Your California Privacy Rights

The CCPA gives California Consumers certain rights. Where required, we will ask you to verify your identity before honoring your requests (this includes for requests made by authorized agents).

Right to Access/Know. You have the right to request that we provide you with the following information:

• The categories and specific pieces of Personal Information we have Collected about you in the last twelve (12) months.
• The categories of sources from which we Collect Personal Information.
• The Business or Commercial Purposes for Collecting or Using Personal Information.
• The categories of Personal Information we have disclosed about you for a Business
• Purpose and the categories of recipients to which it was disclosed.

Right to Delete. You have the right to request that we delete Personal Information under certain circumstances, subject to several exceptions.

Right to Correct. You have the right to request that we correct Personal Information that we maintain about you if you believe it is inaccurate. We may request documentation from you in connection with your request. Upon receipt of a verifiable request to correct inaccurate Personal Information, we will use commercially reasonable efforts to correct the Personal Information. You can also correct certain Personal Information that we maintain about you by logging into your Ford account.

Right to Non-Discrimination for the Exercise of Your Privacy Rights. You have a right to not be discriminated against for exercising rights set out in the CCPA.

How to Exercise Your California Privacy Rights

If you are a resident of California, you can exercise your CCPA rights by submitting your request(s) to us through emailing us at info@lat.ai or by calling us at (412) 525-3483.

If you want to exercise more than one of your CCPA rights, please submit a separate request for each CCPA right, so we can track and respond to your requests more effectively. Please be aware that we will process your requests in the order we receive them.

Whether you email or call us, we will need information from you to process your request so that we can confirm you are a California resident; determine if we have Personal Information about you; and, for access, correction, and deletion requests, verify your identity.

Please be aware there might be circumstances where we will not honor your request, as permitted under the CCPA. For example, if we are not able to verify your identity and that you are a California resident, we may not honor your request. In addition, we may not delete your Personal Information if an exception under the CCPA applies.

You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under the CCPA. Before accepting a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.
